After the Event Legal Expenses Insurance (ATE) 

(ATE) insurance protects against the risk of paying an opponent’s costs in litigation or arbitration.

Cover can be extended to own legal fees and strengthened to meet security for costs requirements, and used with or without litigation funding.

Work in Progress Insurance

(WiP) insurance protects law firms against fees at risk when acting under CFAs or DBAs. Cover can be arranged on a case-by-case or portfolio basis, with terms tailored to the level of risk.

Capital Protection

Insurance (CPI) 

(CPI) protects capital invested in litigation, whether by a funder, claimant, or creditor paying the legal fees. Cover can be arranged on a case or portfolio basis, with terms tailored to the investment structure.

Arbitral Award Default Insurance (AWDI) 

(AWDI) protects against the risk of a state defaulting on payment of an arbitral award in bilateral investment treaty cases, with cover available from a limited number of specialist markets.

Judgment Preservation Insurance (JPI) 

 (JPI) protects a portion of damages awarded at first instance against the risk of reduction or loss on appeal.

It is a case-specific product available from a limited and increasingly selective market.

Adverse Judgment

Insurance (AJI) 

 (AJI) provides defendants with protection against damages that may be awarded against them.

While availability is limited, specialist markets can still offer cover in

suitable cases.

Litigation Funding 

Litigation funding provides capital to support large commercial disputes, helping manage cost and risk. Funding terms vary significantly between providers and are often combined with ATE insurance to

de-risk cases.
